Definitions

In the terms set forth below, “TransparentAir.com” is defined as TransparentAir.com, LLC, a Minnesota Limited Liability Company with offices at 1113 Aspen Drive, Burnsville, Minnesota  55337, and any other subsidiaries or affiliates.

 

The terms “website(s)” and “site(s)” refers to all pages and applications hosted under the following domains: www.transparentair.com, www.transparentshop.com, www.myclearmarket.com, and www.tranparentair.net as well as all associated mobile applications and associated social media accounts.

 

“Fee-Based Service(s)” include but are not limited to paid online access to TransparentAir.com (www.transparentair.com) and the TransparentAir.com “Fee Schedule” available online.

 

“Sales Order” means the form (whether paper or electronic) on which the Subscriber applies for Fee-Based-Services and may include certain additional Terms of Service.

 

“Terms of Service(s)” or “Term(s)” or “Terms and Conditions” include the following provisions as maintained at www.tranparentair.com and the provisions in your Sales Order that set forth the manner in which TransparentAir.com provides Websites and Fee-Based Services to Subscribers.

 

“Your Account” is the “Subscriber” profile maintained by TransparentAir.com including all balances, history, employee records, aircraft records, documents, and any other information associated to or linked to the Subscriber by TransparentAir.com.

 

“Subscriber(s)” is anybody that agrees to this Terms of Service contract to create an account on TransparentAir.com.   “Subscriber(s)” include “Member-User(s)” and also “Company-Users.”

 

“Company-User(s)” are Subscribers that create, access, and use TransparentAir.com through the “Company Dashboard.”

 

“Member-User(s)” are Subscribers that create, access, and use TransparentAic.com through the “Member Dashboard.”

 

The “Company Dashboard” is the user portal on the TransparentAir.com Website where Subscribers manage their company, including but not limited to adding or removing registered aircraft to their Company Fleet, adding or removing authorized Employees, and paying and viewing their invoices that result from their Authorized Employee usage of TransparentAir.com.

 

The “Member Dashboard” is the user portal on the TransparentAir.com Website where Subscribers participate in the user community.  From the Member Dashboard, Subscribers are able to do things such as, but not limited to, post offers, post requests, search the airport directory, search the company directory, and browse other Subscribers posted offers.

 

“Authorized Employee(s)” and “Employee(s)” are Member-User(s) that are authorized by the Company-User(s) to conduct business on the behalf of the Company-Users company.  Company-User authorizes a Member-User as an Employee by adding them to their Company Employees List.  The Company-User is responsible for any charges or fees incurred by their Employees when they are acting on that Company-Users behalf.

TransparentAir.com respects your individual privacy. This privacy policy documents our adherence to the highest industry standards for the protection of your personal information.

 

 

Information Collection and Use

TransparentAir.com is the sole owner of the information collected through our websites and applications. TransparentAir.com may collect information from you at two different stages. First, we may collect anonymous, aggregate information from all visitors to the site.

Second, we require the submission of certain personally identifiable information when you subscribe to use TransparentAir.com services. For subscribers, registration may require that you submit the following personal information: name, company name, mailing address, email address, telephone number, fax number, user name and password, billing information, and any other information TransparentAir.com decides is important.

 

 

Personal Information of Children Under 13

Registered users of TransparentAir.com services must be at least 18 years of age.  TransparentAir.com services are not directed to children and do not knowingly collect any personally identifiable information from children under 13 years of age.

 

 

Use of Your Personal Information

On some occasions it is necessary for us to send out a strictly service-related announcement. For instance, if our service is temporarily suspended for maintenance, we might send subscribers an email. You may not opt-out of these communications, which are not promotional in nature.

 

By agreeing to the TranparentAir.com Terms of Service the Subscriber authorizes the use of personal information by TransparentAir.com for any communications or actions from TransparentAir.com or its authorized representatives, affiliates, or partners.

 

 

Profile

We store information that we collect through cookies and log files to create a profile of our subscribers. A profile is stored information detailing how individual subscribers use the site. Collected information in a profile is tied to the subscriber’s personally identifiable information.



Cookies

A cookie is a small text file stored on the subscriber’s hard drive for an extended period of time. The cookies can be removed by following Internet browser help file directions. Allowing the TransparentAir.com cookie to remain on your computer makes it easier for you to log in to and use the site. If you reject the cookie, you may still use the site, but you will be required to provide detailed login information.

 

 

Log Files

Log files record internet protocol (IP) addresses, browser types, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the site, track a subscriber’s movement and usage in the aggregate, and gather broad demographic information for aggregate use. Log files record each transaction for purposes of capacity planning and billing and are linked to personally identifiable information.

 

 

Disclosure of Personal Information As Required By Law

Though we make many efforts to preserve subscriber privacy, we will disclose personal information when required by law, if we have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process served on us such as a subpoena or warrant.

 

 

Business Transitions

In the event TransparentAir.com goes through a business transition, such as a merger, acquisition, or sale of a portion of its assets, our subscribers’ personal information may be part of the assets transferred. If, as a result of the business transition, your personally identifiable information will be used in a manner materially different from that stated at the time of collection, you will be given a choice consistent with our Notification of Changes section.

Correcting, Updating, Deleting and Deactivating Personal Information

If your personally identifiable information changes or you decide to cancel your subscription, you may correct, update or deactivate our record of your personally identifiable information. Simply send email to supportme@transparentair.com with subject as REMOVE MY PERSONAL INFO and include your phone number in the body.

 

 

Notification of Changes

If we decide to change our privacy policy, we will post a notice to alert you about the change. If the privacy policy changes materially so that we are going to use your personally identifiable information in a manner different from that stated at the time of collection, we will notify you via email and give you a choice as to whether or not we may use your information in this different manner. However, if you have opted out of all communication with the site, or deleted and deactivated your account, then you will not be contacted and your personal information will not be used in this new manner. In addition, if we make any material changes in our privacy practices that do not affect registered user information already stored in our database, we will post a notice on our Web site notifying subscribers of the change. In some cases where we post a notice we will also email registered users notifying them of the changes in our privacy practices.
